Terms of Service

These Terms of Service ("Terms") govern your use of Driver’s Side ("we," "us," or "our") and the website and service we provide (the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.
1. Service Availability
We may add, change, or remove features, and may suspend or discontinue the Service, in whole or in part, at any time.
Some features, including AI-assisted ones, have usage limits to keep the Service available and affordable for everyone.
2. Eligibility and Accounts
- You must be at least 13 years old to use the Service.
- You’re responsible for maintaining the security of your account and password, and for all activity that happens under your account.
- You must provide accurate information and keep it up to date. Your username can’t impersonate someone else or be misleading.
3. Your Content
You own the content you add to the Service—your profile information, vehicle details, photos, log entries, and everything else you submit ("Your Content"). By posting Your Content, you give us a license to store, display, and distribute it solely as needed to operate and provide the Service to you (and, for anything you don’t mark private, to other visitors).
You’re responsible for Your Content and must have the rights to post it. Don’t post anything that’s illegal, infringes someone else’s rights, or that you don’t have permission to share.
Driver’s Side is built around cars and car culture, so keep Your Content relevant to that. Don’t post pornographic or sexually explicit content, or content unrelated to vehicles and car culture. Violating this can result in your content being removed or your account being banned.
4. Public and Private Content
The Service lets you mark your profile and vehicles as private, which limits who can see them. See our Privacy Policy for exactly how this works, including which content (like VINs, log book entries, and notes) always stays private regardless of your other settings. Anything you don’t mark private should be treated as visible to anyone who uses the Service.
5. Acceptable Use
You agree not to:
- Use the Service for anything illegal or unauthorized.
- Impersonate any person or entity, or misrepresent your affiliation.
- Harass, abuse, or harm another user.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Use automated tools to scrape or access the Service outside of normal use.
- Upload malware or anything intended to disrupt the Service.
6. Intellectual Property
The Driver’s Side name, logo, and the Service itself (excluding Your Content) are owned by us and protected by applicable intellectual property laws. These Terms don’t grant you any rights to our trademarks or branding.
7. Termination
You can delete your vehicles, content, or account at any time from within the Service. We may remove content or ban your account if you violate these Terms—including the content restrictions in Section 3—or if we discontinue the Service. To investigate a suspected violation, our administrators may access content you’ve marked private, including VINs, log book entries, and notes—see our Privacy Policy for details. A banned account can no longer sign in.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We don’t warrant that the Service will be uninterrupted, error-free, or secure.
AI-assisted features (like the Log Book’s auto-fill) can make mistakes. Anything they fill in is only a suggestion, and you’re responsible for reviewing it before you save.
9. Limitation of Liability
To the fullest extent permitted by law, Driver’s Side will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service.
10. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we’ll update the date at the top of this page. Continuing to use the Service after changes take effect means you accept the updated Terms.
11. Governing Law
These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict of law provisions.
